WLMG “Foreigner Choir Competition” Contest Written Rules 2011 These contest rules are specific to the above contest (the “Contest”) conducted by Entercom New Orleans, LLC d/b/a WLMG (collectively, the “Station”). Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well. A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 400 Poydras Street Suite 800 New Orleans, LA 70130 during regular business hours and on the contest page on the Station’s website at www.magic1019.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest. How to Enter 1.No Purchase Necessary to enter or win the Contest. 2.Contest will begin at 12pm CT on Monday August 22, 2011 and end at 11:59am CT on Friday September 2, 2011. 3.Beginning at 12pm CT on August 22, 2011, Station will give New Orleans area high school choirs the opportunity to participate in the “Magic 101.9 Foreigner Choir Competition” for the chance to win an opportunity to perform on stage with the band Foreigner (the “Band”) during their concert on Saturday, September 10, 2011 at the New Orleans Arena (hereafter referred to as “Venue”). The winning choir would sing backup during Band’s performance of their one (1) song, “I Want to Know What Love Is”. 4.High schools (grades 9-12 with students at least 14 years of age or older) wishing to participate may be public or private, but must be located in one the following Louisiana Parishes: Orleans, Jefferson, St. Tammany, St. Charles, St. John the Baptist, St. James, St. Bernard, Lafourche, Terrebone, Plaquemines, Washington, Tangipahoa, and accredited by the State of Louisiana; or in one of the following Mississippi Counties Hancock, Pearl River and be accredited by the State of Mississippi. 5.One entry per choir (each an “Entry” and collectively “Entries”). High schools that have multiple choirs based on grade level, size, etc, may submit multiple Entries provided that no person performs in more than one Entry. Each Entry must be submitted as a separate compact disc (CD) or mp3 and must include the following: (a)your contact information ( name, address, daytime telephone number, email address) (b)school and choir name with physical address and contact information (c) CD or mp3 of Entrant’s performance CD entries may be submitted via mail or dropped off at Station studios, 400 Poydras Street Suite 800 New Orleans, LA during regular business Monday – Friday, 8:30am – 5pm (excluding holidays). Mp3 entries may be submitted by clicking the “Magic 101.9 Foreigner Choir Competition” link on Station website www.magic1019.com and following the on-screen instructions. 6.Entry deadline is Wednesday August 31, 2011 at 5pm CT. Entries received after this deadline will not be entered into the Contest. 7.For the purposes of this Contest, a “Choir” is defined as a singing group containing no less than fifteen (15), but no more than thirty (30) performers. Entries containing fewer than fifteen (15) or more than thirty (30) performers will not be accepted. Performers must be high school students of grades 9 through 12 who are at least age 14. 8.High school choir directors (hereafter referred to as a “Representative” or an “Entrant”) are responsible for submitting an Entry before 5pm CT on Wednesday August 31, 2011. Each entry must include a vocal performance of the song, I Want to Know What Love Is. Lyrics and song clips will be available for reference purposes on Station website www.magic1019.com, the school and choir name, the school’s physical address, and Representative’s name and contact information (work phone number, cell phone number, and e-mail address). 9.The Representative submitting the Entry is responsible for obtaining written permission from ALL performers (or from a parent or legal guardian if the performer is under 18 years of age), consenting to submission of the Entry and participation in the Contest and must sign a certification (“Certification”) to this effect in the form attached to these Contest rules as Attachment “A” and submit it with their Entry. Representatives must be employees, not students, of the high school for which they are submitting an Entry, and 18 years of age or older. Please Note: Failure to submit the items as requested (including sending more than 1 song per choir) will result in immediate disqualification. 10.By entering this Contest, Entrants represent warrant and covenant that they have obtained permission from all performers (or from a parent or legal guardian if the performer is under 18 years of age), consenting to submission of the Entry, participation in the Contest and agreement to the terms of these official Contest rules. 11.By entering this Contest, Entrants represent warrant and covenant they will be available and able to perform with Band during their concert at Venue on Saturday September 10, 2011. Further, Entrants represent warrant and covenant that they have obtained permission from all performers (or from a parent or legal guardian if the performer is under 18 years of age), consenting to their performance at Venue on Saturday September 10, 2011. 12.By entering this Contest, Entrants understand and agree that Station may elect to use any Entry submitted for entertainment purposes on-air and may choose to “make fun” of any entry submitted. Entrants waive any right to make any claim against Station, Band, or any Contest sponsors with respect to any disparaging comment made on-air about such entrant’s entry. 13.By entering this Contest, Entrants and associated high schools which Entrant represents agrees to indemnify, defend and hold Station and Band harmless from and against any claims, expenses proceedings, suits, actions or costs (including costs from reasonable attorneys’ fees) of any kind or nature incurred by Station on account of a breach by Entrant of any of their representations, warranties, covenants or agreements as a result of Entrant’s participation in the Contest. How to Win 14.Starting on or about 12pm CT on Wednesday August 24, 2011 through approximately 5pm CT on Wednesday August 31, 2011, some or all of the qualifying entries received by Station will be posted on-line at www.magic1019.com so that listeners and visitors may vote for their favorite entry. LISTENER VOTING IS FOR ENTERTAINMENT PURPOSES ONLY AND WILL NOT BE A DETERMINING FACTOR IN SELECTING WINNERS. LISTENER VOTES MAY BE TAKEN INTO CONSIDERATION, BUT WILL NOT BE A SIGNIFICANT DETERMINING FACTOR AS TO WHICH ENTRANT WILL BE CONTEST WINNER. 15.On or about 12pm CT on Friday September 2, 2011, Station staff and/or management will select one (1) winner (subject to eligibility verification and compliance with these contest rules) as the Entry Station judges deem the best based on any lawful criteria as determined by the Station in its sole discretion. Prize(s) 16.One (1) Prize (the “Prize”), valued at $500, will be awarded in this contest. The verified winner in this contest will receive: •On-stage appearance by high school choir to sing back-up during Band’s performance of “I Want to Know What Love Is” during concert at the Venue on Saturday September 10, 2011. Exact time of Choir arrival and performance TBA. 17.Prize does not include transportation of Choir to and from Venue for any rehearsal or actual performance on night of the concert. 18.The Prize is contingent upon the concert occurring on September 10, 2011, which is beyond the Station’s control. Station is not responsible if Winner is unable to go on stage and perform if the artist or Venue determines this is not allowable for any reason. In the event of illness, act of god, scheduling conflict or any other reason, Station is not responsible for this portion of the prize and no alternate prize will be awarded. Sponsors 19.Sponsors of this Contest are: Foreigner and Entercom New Orleans, LLC. Other Rules Specific to This Contest 20.Station retains sole and exclusive possession and retains all rights to use any performance Entry, or any part thereof, indefinitely in any promotions including but not limited to on-air usage without any compensation to Entrants or any third parties. The aforementioned stipulations apply to all winning and non-winning Entries. Station is not responsible for any costs associated with submitting any Entry or any costs arising out of participating in the Contest or failure to adhere to official Contest rules. 21.Station is not responsible for technical problems that may impact the ability of CD Entries to play in a CD player or mp3 entries to properly download and play on Station computer.
