Santa Baby Photo Contest – Official Contest Rules
These contest rules are specific to the above contest conducted by Entercom New Orleans, LLC d/b/a WLMG (collectively, the “Station”). Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well. A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 400 Poydras Street Suite 800 New Orleans, LA 70130 during regular business hours and on the contest page on the Station’s website at www.magic1019.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.
How to Enter
1. No purchase is necessary to enter or win Magic 101.9’s Santa Baby Photo Contest (“Contest”).
2. To enter from 12AM (CT) on November 12, 2012 through 12PM (CT) on December 21, 2012, go to www.magic1019.com, and click on the graphical “Santa Baby” contest link.
3. The entry/registration process will require you to either log into an existing account, or create a free account with the game administrator, UPICKEM. You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s name, address, phone number and e-mail address. Limit one registration per e-mail address and limit one qualified entry per registration. Multiple entries from the same entrant will be discarded. Only the first chronologically qualified entry will be considered. All subsequent entries will be discarded.
4. Click on the “Upload Photo” tab and:
a. Submit only one (1) photograph of your child, and only your child, in either the “.jpeg” or “.jpg” file format (no other formats will be accepted),
b. Enter your child’s first name, your child’s last initial, your child’s age, and the town/city where you live, and
c. Affirmatively check the box or “I agree” button, expressly confirming the following:
• Entrant represents and warrants that he/she is over 21 years of age.
• Entrant represents and warrants that he/she own the rights to, or have obtained permission to use, the photo submitted with the entry.
• Entrant represents and warrants that he/she own the rights to, or have obtained permission to use, the photo submitted with the entry.
• Entrant represents and warrants that the child depicted in the photo is 4 years old (i.e., not yet, five (5) years old) or under as of the time of entry, and that the submitted photo was taken no more than three (3) months prior to the date of entry in this contest.
• Entrant represents and warrants that he/she is the parent or legal guardian of the child depicted in the photo.
• Entrant represents and warrants that he/she authorizes Station to post the photo on Station’s website or social network sites or use the photo in any other way Station sees fit.
• Entrant agrees and acknowledges that Station, all contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors: may use the Entrant’s name, image, photo submission, other entry materials and/or biographical information for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation.
• Entrant understands and agrees that Station shall be the sole and exclusive owner of the photo submitted, whether or not the photo is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.
• By submitting a photo in a Station contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable contest rules prove to be false or inaccurate.
• Entrant acknowledges and agrees that the contest rules are available to him/her at www.magic1019.com, he/she has had an opportunity to review them before entering this contest and agrees to be legally bound by the contest rules. Contest rules are also available Monday through Friday (excluding holidays) during normal business hours between 9am (CT) and 5pm (CT) at the Station’s studios located at 400 Poydras Street, Suite 800, New Orleans, LA, 70130.
5. Each Entrant may submit only one (1) entry in this contest and Entrant must be the parent or legal guardian of the child depicted in the photo. Station will disqualify any photo received from an Entrant who is not the parent or legal guardian of the child depicted therein. Station will discard multiple entries from the same Entrant (whether containing photos of the same or of different babies) and only the first qualifying entry received will be eligible to participate.
6. The child depicted in the submitted photo is Entrant represents and warrants that the child depicted in the photo is 4 years old (i.e., not yet, five (5) years old) or under as of the time of entry (the “Age Requirement”), and that the submitted photo was taken no more than three (3) months prior to the date of entry in this contest. The child depicted in the photo must be at least covered with a diaper, blanket, or other covering such that the “diaper area” (area that a standard diaper would cover) is not exposed.
7. Both the entering parent/legal guardian and the child must be eligible to win in this contest (other than the minimum entry age restriction with respect to the child).
8. By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted. Entrants waive any right to make any claim against Station or any contest sponsors with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry.
9. By submitting a photo to the Station for this contest, each Entrant authorizes the Station to post such photo to the Station’s website at www.magic1019.com. Station will not post all entry photos received on the Station’s website.
10. Photograph entries must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. Photograph entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the entrant, the Station, or a Contest Sponsor. BY ENTERING THIS CONTEST AND SUBMITTING PHOTOGRAPH, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH PHOTOGRAPH WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS. By submitting a photo, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.
How to Win
11. Starting on or about November 12, 2012 through approximately 12PM (CT) on December 21, 2012, some or all of the photo entries received by Station will be posted on-line at www.magic1019.com so that listeners and visitors may view and vote for their favorite entry as many times as they wish (subject to Station’s right to implement limits as set forth in the general contest rules). LISTENER VOTING IS FOR ENTERTAINMENT PURPOSES ONLY AND WILL NOT BE A DETERMINING FACTOR IN SELECTING WINNERS. LISTENER VOTES MAY BE TAKEN INTO CONSIDERATION, BUT WILL NOT BE A SIGNIFICANT DETERMINING FACTOR AS TO WHICH ENTRANT WILL BE CONTEST WINNER.
12. After 12:00PM (CT) on December 21, 2012, Station staff and/or management will select the potential grand prize winner from among all qualified entries, based on evaluation of the submitted photo (in their subjective opinion), and/or any other any lawful criteria Station judges deem desirable, subject to verification of eligibility and compliance with these contest rules. Station judges may take the number of votes received into consideration (but is not obligated to) but voting will not be a determining factor in the selection of the winner.
13. Station will announce the name of the grand prize winner on- air at approximately 5pm (CT) on December 21, 2012. The potential grand prize winner need not listen in order to win. Station will contact the potential grand prize winner. Should the potential grand prize winner not meet the eligibility requirements or is disqualified for any other reason, an alternate grand prize winner may be selected by Station but in the event such alternate grand prize winner does not meet eligibility requirements or is disqualified, no grand prize will be awarded in this Contest.
Prize(s)
14. Station will only award one (1) Grand Prize in this contest. The Grand Prize is valued at approximately $1,674 and consists of the following:
- One (1) Omni Orlando Resort at ChampionsGate gift certificate redeemable through December 31, 2013 for two (2) nights deluxe accommodations for a family of up to four (4) with self-parking for one car, unlimited use of Champions 9 golf course, and scheduled transportation to area theme parks (valued at valued at approximately $799 ($399.98 per night), may require winner to present a major credit card at check-in, does not include transportation to and from destination resort, subject to availability with advanced reservations, and winner is responsible for all local taxes, resort fees, gratuities, and all incidental charges incurred during stay).
- Six (6) $50 ExxonMobil gas cards (each redeemable for authorized products and services only at Exxon and Mobil facilities, will not expire nor be subject to maintenance fees for nonuse, may not be redeemed for cash, and remaining value may be replaced on a lost, stolen or damaged card only if the account number and remaining value on the card can be verified)
- One (1) $250 Lakeside Camera Photoworks Service gift card (redeemable only toward the purchase of services, may not be redeemed for cash or the purchase of any merchandise, will not expire nor be subject to maintenance fees for nonuse, and will not be replaced if lost or stolen)
- One (1) $100 Toys “R” Us gift card courtesy of Bohn Brothers Toyota (valid toward purchases at Toys “R” Us and Babies “R” Us stores in the United States, or purchases made online at ToysRUs.com or BabiesRUs.com, will not expire nor be subject to maintenance fees for nonuse, may not be redeemed for cash, remaining value on a lost, stolen, or damaged card may be replaced with proof of purchase)
- One (1) family 4-pack of VIP “Skip the Line” tickets to Santa’s Secret Workshop (valued at $100, must be presented at the door for almost instant access during regular operating hours through December 24, 2012)
- One (1) $100 Zuppardo’s Family Supermarket gift certificate (valid toward the purchase of merchandise only, not redeemable for cash, and will not be replaced if lost or stolen)
- One (1) $25 New Orleans Original Daiquiri gift card (will not expire nor be subject to maintenance fees for nonuse, not redeemable for cash, and will not be replaced if lost or stolen)

15. The sponsors of this contest Bohn Brothers Toyota, Omni Orlando Resort at Champion’s Gate, Lakeside Camera Photoworks, Zuppardo’s Family Supermarket, New Orleans Original Daiquiris, Santa’s Secret Workshop, and Entercom New Orleans, LLC.
Other Rules Applicable to this Contest
16. In order to receive the grand prize, the grand prize winner will be required to produce documentation (including but not limited to a birth certificate or court order appointing a legal guardian) establishing that: 1) they are the parent or legal guardian of the baby depicted in the selected photo, and 2) the depicted child meets the Age Requirement. grand prize winner must present the required documentation in person at Station’s studios at 400 Poydras, Suite 800 New Orleans, LA, 70130 when picking up grand prize.
17. Station is conducting this contest using proprietary software owned by a third party known as Second Street Media Inc. (“UPICKEM”). UPICKEM is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to UPICKEM’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “UPICKEM Policies”) and may be required to register with UPICKEM. While agreement to the UPICKEM Policies is required in order to enter this contest, the UPICKEM Policies are not a part of these contest rules but are a separate agreement between the entrant and UPICKEM. With respect to the conduct of this contest by Station, in the event of any conflict between the UPICKEM Policies and the Station contest rules, the Station’s contest rules govern.
18. Station is not responsible for any error or technical malfunctions associated with the UPickEm site that may affect any entrant’s ability to enter, win, or be properly considered in this Contest, regardless of the cause. In the event of a malfunction associated with the UPickEm site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances. Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.
19. Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible to win in this Contest.
